Terms and conditions

1. Scope

1. The accommodation contract is concluded as soon as the accommodation has been booked and confirmed or, if confirmation was not possible due to time constraints, provided.
2. The conclusion of the accommodation contract obliges the contracting parties to fulfill the contract, regardless of the duration for which the contract was concluded.
3. The subletting or re-letting of the rooms provided, as well as their use for purposes other than accommodation, require the prior written consent of English Romance Service GmbH.
4. The customer's general terms and conditions shall only apply if this has been expressly agreed in writing in advance.
5. The day of arrival and the day of departure count as one day.
6. The exclusive place of jurisdiction is the place of business.

2. Conclusion of contract, contractual partners, statute of limitations

1. English Romance Service GmbH is free to confirm the room reservation in writing.
2. The contractual partners are English Romance Service GmbH and the customer. If a third party has placed the order on behalf of the customer, they shall be jointly and severally liable to English Romance Service GmbH together with the customer.
3. All claims against English Romance Service GmbH shall generally become time-barred one year after the start of the statutory limitation period. Claims for damages shall become time-barred after five years.
4. The reductions in the limitation period shall not apply to claims based on an intentional or grossly negligent breach of duty by the hotel.

3. Services, prices, payment, offsetting

1. English Romance Service GmbH is obliged to keep the rooms booked by the customer available and to provide the agreed services.
2. The customer is obliged to pay the applicable prices of English Romance Service GmbH for the provision of rooms and any other services used by them. This also applies to services and expenses incurred by English Romance Service GmbH to third parties at the customer's request. The agreed prices include the applicable statutory value added tax. English Romance Service GmbH may make its agreement to a subsequent reduction in the number of rooms booked, the services provided by English Romance Service GmbH, or the length of the customer's stay requested by the customer dependent on an increase in the price for the rooms and/or for the other services provided by English Romance Service GmbH.

3. English Romance Service GmbH is entitled to demand an advance payment or security deposit from the customer upon conclusion of the contract.
4. In justified cases, e.g. payment arrears on the part of the customer, English Romance Service GmbH is entitled to refuse further services.
5. The customer may only offset or set off a claim against a claim by English Romance Service GmbH if the claim is undisputed or legally binding.

4. Cancellation by the customer (cancellation,
cancellation & no-show)

1. Cancellation by the customer of the contract concluded with English Romance Service GmbH requires the consent of English Romance Service GmbH in writing. If this is not given, the agreed price from the contract must be paid even if the customer does not make use of the contractual services.
1.1. The guest is obliged to pay the agreed or customary price if they do not make use of the contractual services.
2. If a date for free withdrawal from the contract has been agreed in writing between English Romance Service GmbH and the customer, the customer may withdraw from the contract until that date without triggering any payment or compensation claims from the accommodation provider. The customer's right of withdrawal expires if they do not exercise their right of withdrawal in writing to English Romance Service GmbH by the agreed date.  
3. For rooms not used by the customer, English Romance Service GmbH shall offset the income from renting these rooms to other parties. If the rooms are not rented to other parties, English Romance Service GmbH may charge 100% of the contractually agreed remuneration. The right to withdraw from the contract concluded with English Romance Service GmbH expires two weeks before the contractually agreed arrival date. Note: In accordance with Directive 2011/83/EU of the European Parliament, Article 16, the 14-day right of withdrawal does not apply to room bookings. The cancellation conditions of the accommodation contract apply.
